PORTLAND, OR — Federal prosecutors filed charges Jan. 12 against a man shot by U.S. Border Patrol agents during a targeted immigration enforcement stop in Portland, Oregon, the U.S. Department of Justice said.

The criminal complaint unsealed in U.S. District Court alleges that Luis David Nino-Moncada, 37, intentionally rammed an unoccupied Border Patrol vehicle with his pickup truck during the Jan. 8 traffic stop and then fled the scene.

Nino-Moncada is charged with aggravated assault of a federal officer with a deadly or dangerous weapon and depredation of federal property exceeding $1,000. The complaint states that the Border Patrol agents had ordered the occupants to exit the vehicle before the alleged maneuver that damaged the federal vehicle.

Border Patrol agents shot Nino-Moncada during the incident; he was treated at a hospital and then taken into custody. A passenger in the vehicle, Yorlenys Betzabeth Zambrano-Contreras, was also struck by gunfire and hospitalized, and federal prosecutors filed separate charges against her for illegal entry into the United States.

Federal court proceedings have been scheduled, including detention and preliminary hearings, and Nino-Moncada remains detained as the case moves forward, officials said.
